1. Acceptance of Terms

By accessing or using Wowzo ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Wowzo. Please read them carefully before using our Service.

2. Service Description

Wowzo is an AI-powered book generation service that creates personalized books based on your parameters. Our Service uses advanced AI technology (Claude by Anthropic via AWS Bedrock) to generate unique content including:

• Book outlines and story structures
• Chapter content based on your specifications
• Character development and narrative elements
• Final formatted books (PDF and EPUB formats)

3. Account Registration

To use our Service, you must:

• Be at least 16 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Maintain only one account per person

You are responsible for all activities that occur under your account.

New users receive their first book free as a trial. No payment required for the first book.

5. Subscription Terms

• Billing Cycle: Subscriptions are billed monthly on the anniversary of your subscription start date.
• Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings. You will retain access until the end of your current billing period.
• No Carry-Over: Unused book credits do not carry over to the next billing period.
• Refunds: Subscription fees are non-refundable except as required by applicable law or at our discretion.

6. Intellectual Property

Your Content

You retain ownership of any original content you provide to the Service (book parameters, character descriptions, story elements). You grant us a license to use this content solely for the purpose of providing the Service.

Generated Books

You own the books generated for you through our Service. You have the right to:

• Use the generated content for personal purposes
• Publish and distribute the generated books commercially
• Modify and create derivative works from your generated books
• Sell your books through our Marketplace or other platforms

Our Service

The Wowzo platform, including its software, design, and branding, remains our intellectual property. You may not copy, modify, or distribute our Service.

7. Marketplace Terms

If you list books for sale on our Marketplace:

• Listing: You may list your generated books for sale at USD 2.99 per book.
• Revenue Split: Sales revenue is split 70/30 between you (the author) and Wowzo.
• Earnings: Your earnings are credited to your Stripe customer balance.
• Gift Card Conversion: You may convert EUR 9.99 of earnings into a gift card for yourself or others.
• Responsibility: You are responsible for ensuring your listed content complies with our content standards.

8. Acceptable Use

You agree not to use our Service to:

• Generate illegal, harmful, or offensive content
• Create content that infringes on intellectual property rights
• Generate content promoting violence, hate speech, or discrimination
• Produce content that sexualizes minors or depicts illegal sexual acts
• Create misleading content presented as factual (e.g., fake news)
• Attempt to circumvent our security measures or abuse the Service
• Use automated systems to access the Service without permission
• Share your account credentials with others

We reserve the right to suspend or terminate accounts that violate these terms.

9. Content Standards

All generated content must:

• Include appropriate age ratings when listed on the Marketplace (Kids, Young Adult, Adult)
• Not contain plagiarized content from existing copyrighted works
• Not misrepresent AI-generated content as human-written (where disclosure is required)
• Comply with applicable laws regarding content distribution

10. Service Availability

Our Service is provided "as is" and "as available." We do not guarantee:

• Uninterrupted or error-free service
• Specific uptime or availability
• That generated content will meet your expectations
• Compatibility with all devices or browsers

We may perform maintenance, updates, or modifications to the Service at any time.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total liability shall not exceed the fees you paid to us in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• We are not liable for loss of data, revenue, profits, or business opportunities.
• We are not responsible for content generated by the AI that may be inaccurate or inappropriate.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or death/personal injury caused by negligence.

12. Indemnification

You agree to indemnify and hold harmless Wowzo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties.

13. Dispute Resolution

Governing Law: These Terms are governed by the laws of the Netherlands and applicable EU regulations, without regard to conflict of law principles.

Jurisdiction: Any disputes shall be resolved in the courts of the Netherlands.

EU Online Dispute Resolution: If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

Consumer Rights: Nothing in these Terms affects your statutory consumer rights under EU or national law that cannot be waived by agreement.

14. Termination

By You

You may terminate your account at any time by cancelling your subscription and requesting account deletion through our contact form.

By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Fail to pay applicable fees
• Abuse the Service or other users

Effect of Termination

Upon termination, your access to the Service will cease. We will retain your data as described in our Privacy Policy. You may request deletion of your data at any time.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wowzo.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations.
• Modifications: We may modify these Terms at any time. Material changes will be notified via email.
